1. Acceptance of Terms
By accessing and using this website, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.
2. Commissioned Artwork
All commissioned artwork is created exclusively for the client upon agreement. Commissions require a non-refundable deposit of 50% before work begins. The remaining balance is due upon completion and before delivery or installation. Diane Kole retains the right to photograph and use images of all completed works for portfolio and promotional purposes unless otherwise agreed in writing.
3. Copyright & Intellectual Property
All artwork, images, and content on this website are the exclusive intellectual property of Diane Kole. Reproduction, distribution, or use of any content without prior written consent is strictly prohibited. Purchasing or commissioning a piece grants the buyer ownership of the physical work only — copyright remains with the artist.
4. Cancellations & Refunds
Commissioned artwork deposits are non-refundable. If a client cancels a commission after work has begun, Diane Kole retains the deposit and any additional payments made for work completed to that point. Completed and delivered works are non-returnable unless there is a documented defect in materials.
5. Shipping & Delivery
Diane Kole offers local delivery and installation throughout Florida. For out-of-state commissions, shipping arrangements and costs will be agreed upon prior to completion. Risk of loss passes to the buyer upon delivery. Diane Kole is not responsible for damage occurring after delivery.
6. Privacy Policy
Personal information collected through this website (name, email, phone) is used solely for the purpose of responding to inquiries and fulfilling commissions. This information is never sold or shared with third parties. By submitting your information, you consent to being contacted by Diane Kole regarding your inquiry.
7. Website Accuracy
While every effort is made to ensure the accuracy of information on this website, Diane Kole makes no warranties regarding the completeness, reliability, or accuracy of this information. Colors and textures of artwork may appear differently on screen than in person due to monitor calibration and photography conditions.
8. Limitation of Liability
Diane Kole shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of this website or the purchase of artwork. Total liability shall not exceed the amount paid for the specific commission or purchase in question.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Sarasota County, Florida.
